Terms of Use for Real Estate Agents and Brokers

In addition to abiding by the General Terms of Use for any users of Whoovia, Real Estate Professionals must abide by the following Terms of Use.

The ever-changing marketplace for real estate brokerage and agency demands constant creativity in the agent’s offering to consumers. Whoovia exists to partner with great agents in this endeavor to increase their value to the consumer. Whoovia allows partner agents to offer buyers another vehicle to encounter the best possible home and makes it possible for these agents to leverage curated, local data that cannot be found without employing their assistance.

By using Whoovia, you understand that:

Whoovia is a platform where agents, buyers, and sellers can begin a conversation about the possibility of a real estate transaction.

Whoovia is not a Brokerage, an MLS (Multiple Listing System), a transaction management system, or a social platform.

Consistent with the highest ethical standards, all partner agents must agree to adhere to any applicable local association rules and jurisdictional law. Failure to do so is grounds for immediate expulsion from Whoovia.

All agents must be licensed in the jurisdictions where they create buyer listings.

The integrity of the platform depends on reliable data. Whoovia has the right to audit agents to ensure they are listing genuine buyers. Falsifying buyer information is strictly prohibited.

Whoovia takes special pains to ensure the protection of consumer data and abide by fair housing laws. All partner agents and brokers must abide by the Whoovia Fair Housing Policy and Fair Housing Law more generally.

Whoovia Buyer Listings are not an offer to purchase a property. Information contained in a Whoovia listing, Whoovia messages, and information communicated verbally, via email, or text about a Whoovia buyer or seller’s terms, price range, timing, or any other representations are not contractually binding. All contracts must be agreed to in writing by all parties to the contract.

Whoovia is not a platform for seller listings; instead, it is a forum where buyers are listed to become discoverable by sellers. Property owners are free to create a profile, claim a property that they own, and engage with agents and their buyers regardless of the listing status of their home on other platforms.

You are expected to always do what’s best for the consumer.

Prohibited Conduct:

The following actions are grounds for the immediate suspension or revocation of your membership:

  • Contacting an owner of any property on Whoovia without the owner’s permission.

  • Disparaging an individual agent, broker, manager, or company.

  • Discussing the setting of commission rates or other agent compensation on Whoovia.

  • Receiving repeated violation notices or warnings related to your misuse of Whoovia.

  • Behaving unethically or violating local brokerage or REALTOR® Association Rules or Codes of Conduct.

  • Providing your Whoovia login information to a unauthorized member.

  • Violating Whoovia’s User Agreement.

  • Abusing or misusing the platform.

  • Communicating information about a property or buyer not represented by you.

  • Publishing a listing without the buyer’s permission.

  • Listing the same information more than once.

  • Making derogatory remarks about another agent or brokerage.

General Guidelines for Using Whoovia:

  • Only create listings for motivated and qualified buyers you represent.

  • Use all fields that show off your buyer’s ability to see a transaction through.

  • Review edits made to a listing to ensure compliance with Fair Housing Law.

  • Reshare listings with your past clients, followers, sphere of influence, farm areas, and general network.

  • Reply to seller inquiries in a timely manner.

  • Keep your buyers abreast of your conversations with the owners of the property.

  • Proofread your listings carefully before posting.

  • Verify that any prospective seller is the owner of the property before beginning any negotiations.

  • Always act in the best interest of your clients.

  • ABIDE BY ALL RULES AND PROCEDURES OF ANY BROKERAGE OR REALTOR ASSOCIATION TO WHICH YOU BELONG.

Whoovia is not responsible for policing your actions relative to these rules and procedures. However, your failure to adhere to these rules is grounds for the suspension/revocation of your membership on Whoovia.

Decisions regarding membership abuse, posting violations, and other Terms of Use violations will be made entirely at Whoovia’s sole discretion and will be considered final.
