Terms of Use, Whoovia, Inc.

Welcome to Whoovia, a marketplace for top real estate agents, buyers, and sellers. By accessing or using our platform, you agree to comply with and be bound by the following terms:

User Agreement:

  • Users must adhere to all applicable laws governing their local marketplaces where real estate assets are bought and sold when using our platform.

  • Respect the rights and privacy of other users and third parties. If a user does not wish to be contacted, they can opt out of your communications. If a user wishes to report your activity to Whoovia, they may choose to do so. Whoovia may take corrective action and remove you from the platform if you continue to engage in abusive, illegal, or soliciting behavior.

Real Estate Transactions:

  • Whoovia is a marketplace for real estate assets and properties. Users are solely responsible for any transactions and interactions on or as a result of Whoovia.

  • Buyers and sellers engage at their own risk and discretion.

Indemnification:

  • Users agree to indemnify and hold Whoovia, Inc., its affiliates, and its respective employees and agents harmless from any claims, losses, liabilities, damages, or expenses arising out of or in connection with their use of the platform.

Assumption of Risk:

  • Engaging with other users on the platform involves inherent risks. Users acknowledge and assume these risks, including but not limited to the accuracy of property information, the accuracy of representations made by buyers and agents, the legitimacy of transactions, and the integrity of other users.

  • You acknowledge that you will not discriminate on the this platform relative to race, color, national origin, sex, religion, age, disability, or genetic information.

User Content:

  • Users are solely responsible for the content they post, including listings, profiles, comments, and messages and other profile information.

  • Whoovia reserves the right to remove any content that violates our guidelines or poses a risk to the community.

Dispute Resolution:

  • Users are encouraged to resolve disputes amicably. Whoovia may, at its discretion, provide dispute resolution assistance but is not obligated to intervene in user disputes.

Termination of Accounts:

  • Whoovia reserves the right to suspend or terminate user accounts that violate our terms or pose a risk to the community.

Intellectual Property:

  • Users retain ownership of their intellectual property rights. By posting content on Whoovia, users grant the platform a non-exclusive, transferable, sub-licensable, royalty-free license to use, display, and distribute the content.

Updates and Changes:

  • Whoovia may update these terms periodically. Users will be notified of significant changes, and continued use of the platform constitutes acceptance of the revised terms.

Governing Law:

  • These terms are governed by and construed in accordance with the laws of Delaware. Any disputes arising from or in connection with these terms will be subject to the exclusive jurisdiction of the courts in the state of Delaware.

  • By using Whoovia you agree to abide by these terms. If you do not agree with any part of these terms, please refrain from using our platform.

Whoovia Fair Housing Policy

Whoovia, Inc. is committed to providing fair and equitable service, including housing opportunities, in a manner that is free from unlawful discrimination of any kind. Employees, contractors, and representatives of Whoovia, and licensees who partner with Whoovia, must abide by Whoovia’s fair housing policy at all times, which means, at a minimum, complying with all federal, state and local fair housing laws. Whoovia has zero tolerance for violations of fair housing laws and strictly prohibits discrimination in the provision of any of Whoovia’s services on the basis of race, color, religion, creed, sex, marital status, sexual orientation, gender identity, familial status (including pregnancy, or having children), age, national origin, citizenship or immigration status, the presence of any sensory, mental, or physical disability including recovering from substance abuse, honorably discharged veteran or military status, source of income (including receipt of income from federal, state and local housing assistance programs, housing choice vouchers, emergency assistance payments, Social Security Supplemental Security Income, unemployment insurance payments, alimony, veterans’ benefits, and disability benefits payments), or any other class protected under state, federal and local laws. 

Prohibited practices may include, but are not limited to, the following behaviors, whether overt or indirect: 

  • Denying professional services based on a person being a member of a protected class. 

  • Being a party to any plan or agreement to discriminate based on a person being a member of a protected class. 

  • Refusing to show or sell a property to a person because that person is a member of a protected class. 

  • Refusing to list or show a property in a particular geographic area because of the presence or absence of members of protected classes in that area. 

  • Representing that a property is or is not available for sale, when the property is in fact available, to a member of a protected class, because of that person’s membership in a protected class. 

  • Providing inaccurate or incomplete information about a property to a person because that person is a member of a protected class. 

  • Different treatment or disparate treatment of persons based on their membership in a protected class. 

  • Steering or guiding potential homebuyers to selected properties or areas based on their membership in, or non-membership in, a protected class, or based on their perceived desire to live in an area based on the presence or absence of members of protected classes in that area. 

  • Any statement (including in advertising, marketing, property listings, etc.), whether direct or indirect, that discriminates or otherwise expresses any preference or limitation based on someone’s membership in, or non-membership in, a protected class. 

  • Marketing or targeting service based on people’s membership or non-membership in a protected class. 

  • Harassment based on a person’s membership in a protected class. 

  • Applying different, or more burdensome criteria to individuals based on their membership in a protected class. 

  • Retaliating against a person for reporting a discriminatory practice, or for participating in an investigation into alleged discrimination. 

  • Blockbusting, which is defined as any illegal, discriminatory practice whereby an agent induces a property owner to list her property by suggesting that people of a particular protected characteristic are about to move into the neighborhood.

Employees, contractors, licensees and representatives of Whoovia are prohibited from engaging in any conduct in violation of this policy and may be subject to disciplinary action, up to and including termination for violations of this policy.
